What Traffic Violations Can Result In A Traffic Ticket Warrant In Texas?

blog

Suppose you are driving in Dallas near Six Flags Over Texas or the Dallas Zoo, and you receive a traffic ticket. Most people think that this is not a big deal; however, if you forget to contact the Court prior to your appearance date, a warrant could be issued for your arrest.  The appearance date is cited on your ticket. The appearance date is either a specific date and time or a certain number of days after the stop. Contact the Dallas traffic ticket warrant attorneys at Anderson & Anderson, LLP for more information.

Class C Misdemeanors And Fine-Only Misdemeanors

The most common traffic offenses that can lead to the issuance of a traffic warrant are Class C Misdemeanors that are punishable by a fine. However, if you miss your appearance date and you allow your ticket to go into warrant status, you face not only increased fees but also the possibility of being jailed.

Traffic Offenses

The most common Class C Misdemeanor violations are running a red light, failure to yield, and speeding. According to the Texas Transportation Code, these are moving violations.  If you are convicted of a moving violation, the Texas Department of Public Safety could issue two points on your driving record.

Other Class C Misdemeanors

Most people do not realize that Class C Misdemeanors also include non-traffic violations, such as public intoxication, theft of less than $100, disorderly conduct, minor possession of alcohol, and assault without injury. While these are non-moving violations, you can still get arrested for an outstanding warrant if you do not properly handle the issue prior to your appearance date, such as setting the case for Court, etc.

City Ordinance Violations

Many people do not realize that non-compliance with a city code can lead to the issuance of a ticket.  Some common city code violations include waste disposal, health and safety ordinances, panhandling, solicitation, etc.  Noise pollution, high grass/weeds, and litter are also considered city code violations. If you are cited for any of these offenses and you do not resolve the matter prior to your appearance date, a warrant may be issued for your arrest.

Although the above examples are for offenses that are punishable by fine only, they can result in an arrest if not properly and timely handled.

One exception to these Class C Misdemeanor cases is a Class C Assault with an allegation of Family Violence. What Are the Two Types of Warrants

ALIAS WARRANT: An alias warrant is issued when you fail to address your case prior to your appearance date or if you set your case for Court and fail to appear in Court. You could be arrested and find yourself in a situation that is both embarrassing and inconvenient.  You could face increased court fees and fines. If you miss your appearance date and an alias warrant has been issued for your arrest, please contact our Dallas traffic ticket warrant attorneys at ANDERSON & ANDERSON, LLP.

CAPIAS WARRANT:  This type of warrant is issued when you do not comply with the plea agreement that you signed with the Court.  Not only is a warrant issued for your arrest, but a previous judgment of guilty has been entered, and court fees and fines have probably increased. And to make matters worse, there is no expiration date on a Capias warrant.  Paying the fine in full is the only way to have a Capias warrant lifted to avoid possible arrest. If you need information on how to do this, contact our traffic ticket attorneys at ANDERSON & ANDERSON, LLP. We will provide you with court name, ticket number, and amount owed.

If your case has gone into warrant status,

You may be stopped any time anywhere – at your home, place of employment, or while driving;
Your warrant remains active until you resolve the issue;
You could be subject to non-renewal of your Texas driver’s license;
If you are a non-resident, your driver’s license could be suspended in your home state.

Do not get arrested. It is much better to handle your outstanding matter prior to being arrested. If arrested, you must pay a bond for the full amount to be released from jail. Also, there will be additional court fees, warrant fees, and collection fees. And do not forget that your car could be impounded.
